1. Nature of Services

Sparks Technologies is a Digital Marketing & IT Solutions company offering services such as:

  • Website Development & Maintenance
  • Software & Application Development

2. No Guarantee of Results

  • We do not guarantee leads, sales, rankings, or revenue growth
  • Digital marketing results depend on multiple external factors such as:
    • Market conditions
    • Competition
    • Platform algorithms (Google, Meta, etc.)
    • Budget and targeting

All strategies are executed using industry best practices, but results may vary from client to client.

3. Payment Terms

  • All service fees paid to Sparks Technologies are non-refundable
  • No cancellations, transfers, or adjustments will be made once payment is processed
  • Clients are advised to understand the scope of services before making payment

4. Client Responsibilities

The client agrees to:

  • Provide accurate information, creatives, and approvals on time
  • Ensure proper functioning of their website/landing page
  • Not share confidential credentials (ad accounts, website access, etc.) with unauthorized persons

Sparks Technologies will not be responsible for delays or losses caused due to incomplete or incorrect information provided by the client.

5. Third-Party Platforms

We use third-party platforms such as:

  • Google
  • Meta (Facebook & Instagram)
  • LinkedIn

We are not responsible for:

  • Ad account suspension or restrictions
  • Policy changes
  • Algorithm updates affecting campaign performance

6. Intellectual Property

  • All content, creatives, and strategies developed by Sparks Technologies remain our intellectual property unless otherwise agreed
  • Clients are not allowed to reuse, distribute, or modify materials without written permission

7. Data Privacy & Security

  • We maintain confidentiality of client data
  • Clients must not share login credentials with any unauthorized person
  • Sparks Technologies is not liable for losses due to client-side data breaches

8. Service Modifications

  • The company reserves the right to modify, update, or discontinue any service without prior notice
  • Management decisions will be final and binding

9. Limitation of Liability

Sparks Technologies shall not be liable for:

  • Loss of revenue, business, or data
  • Lead quality or conversion issues
  • Campaign performance fluctuations

All services are provided on a best-effort basis without any performance guarantees.

10. Advisory Disclaimer

Any suggestions, recommendations, or strategies shared by Sparks Technologies are:

  • Based on experience and data insights
  • To be treated as professional opinions, not guaranteed outcomes

Final business decisions remain the sole responsibility of the client.

11. Trial / Demonstration

If any demo or trial is provided:

  • It is only for showcasing service capability
  • It does not guarantee similar results in paid services

12. Refund Policy

  • Sparks Technologies follows a strict no refund policy
  • Clients are advised to review services carefully before payment

13. Dispute Resolution

  • Any disputes shall first be resolved through mutual discussion
  • If unresolved, the matter shall fall under the jurisdiction of: Noida, Uttar Pradesh, India Courts
